Panhandle Pest Protection

Terms and Conditions

These Terms and Conditions apply to the pest control services provided by Insight Pest Solutions AMA LLC, doing business as Panhandle Pest Protection (“we,” “us,” “our” or the “Company”), under our Home Protection Plan and Mosquito Reduction Plan service agreements, and to your use of this website. We are licensed by the Texas Department of Agriculture as Insight Panhandle Pest Protection, structural pest control business license TPCL #1006840.

Items 1 through 9 follow the terms printed on the back of your service agreement and are numbered to match. The commitment, billing, warranty and three-business-day cancellation terms from the front of your agreement follow Item 9, and “Initial Service Commitment” is explained in “Plan Commitment, Billing and Payment.” By signing or otherwise accepting a service agreement with us, and by using this website, you agree to these terms. If anything here differs from your signed service agreement, your signed service agreement controls.

Submitting a quote or contact request on this website does not create a service agreement. A service agreement exists only when a written service agreement has been signed or otherwise accepted by both you and us.

1. Services We Provide

We provide the pest control treatments described in your service agreement, in accordance with these terms and the terms on the front of your agreement. Our only obligation under your service agreement is to provide those treatments.

Add-on services apply only if you select them on your agreement. The Home Protection Plan add-on services are carpenter ants, voles, exterior fleas and ticks, and interior liquid application. Interior liquid application is provided at no additional charge; any charge for the other add-on services is shown on the front of your agreement.

The Home Protection Plan (printed on your agreement as the “Home Services Protection Plan”) is a seasonal protection service that runs year-round, with treatments on a bi-monthly schedule. It covers the following pests:

  • Rats
  • Mice
  • Carpenter bees
  • Wasps
  • Spiders
  • Earwigs
  • Non-wood-boring ants
  • Millipedes and centipedes
  • American and Palmetto roaches
  • Stink bugs
  • Pill bugs
  • Silverfish

1(b) Carpenter Ant Warranty and Treatment

This applies only if you select carpenter ant coverage on the front of your agreement. Carpenter ant activity inside the property, and on the immediately surrounding property at the location shown on your agreement, is covered, and we will treat any carpenter ant activity there. There is no additional charge to treat carpenter ant activity there, other than the charge shown on the front of your agreement.

If we are unable to control or eliminate interior carpenter ant activity, if any exists, after no fewer than three treatments within the bi-monthly (two-month) period of your agreement, you are entitled to stop the service agreement with no fee and to receive a refund of the money paid for the last charge.

1(b) Mosquito Reduction Service

The Mosquito Reduction Plan covers outdoor mosquito activity at the location shown on your agreement. It is a seasonal service of nine visits each year, scheduled from March through November on the schedule shown on the front of your agreement.

We cannot promise complete elimination of mosquito activity at the property. We will use the best available methods to achieve reduction and control. The Mosquito Reduction Plan does not include mechanical control devices, traps or larvicide treatment.

Tick treatment, in which potential harborage sites are treated, is available as an additional service if you select it on your agreement.

2. Your Responsibilities

You agree to receive and pay for the treatments outlined in your service agreement, to make the premises available to us so that we can perform them, and to contain your pets during service visits.

3. Future Damage and Limitation of Liability

A) Your service agreement does not guarantee against present or future insect damage to buildings or contents, and it does not provide for repair or compensation.

B) Your service agreement does not provide for the control or prevention of termites or any other wood-destroying insects or organisms, or any other pest not identified in your agreement, except carpenter ants if you select carpenter ant coverage. You expressly waive and release the Company from any liability and any claim for personal injury or damage to the structure or its contents caused by wood-destroying insects, wood-destroying organisms or any other arthropods, whether or not they are listed in your agreement.

C) We do not guarantee the elimination of bed bugs or protect against the present or future presence of any other arthropod or pest. We are not liable for any actual or consequential damage to the property or its contents that you sustain as a result of bed bugs or any other arthropods or pests. We are not liable for any form of repair to buildings or their contents, or for any injury or damage resulting from contact with any product we use to treat the premises.

Nothing in these terms or in your service agreement excludes or limits our liability for damages resulting from our negligence where such an exclusion is not permitted by law.

4. Cancellation and Early Termination

To discontinue service, you agree to speak with a member of our customer service team, either by calling us at (806) 209-4849 or by visiting one of our local branch offices, and to do so no less than 30 days before your next scheduled service.

If you cancel before completing your Initial Service Commitment, and the initial cancellation grace period (the three business days described in “Your Right to Cancel Within Three Business Days” below) has elapsed, you agree to pay the early termination fee shown on the front of your service agreement, except as provided under the warranty. For the Home Protection Plan and the Mosquito Reduction Plan, that fee is a flat $250.00. This fee represents a reasonable estimate of our administrative costs, scheduling costs and losses resulting from early termination.

If you cancel within the initial cancellation grace period, you are entitled to a full refund of all amounts paid for services, and you must return any goods installed at the service premises, at no cost to you.

There is no cancellation charge after the Initial Service Commitment. If, after the initial service has been performed and the initial cancellation grace period has elapsed, you refuse service either when the technician arrives at the premises or less than 30 days before your next scheduled service visit, you will be charged as indicated on your service agreement for that service visit.

There is no charge to cancel your service agreement either before the initial service has been performed or after the Initial Service Commitment has elapsed. Nothing in this section limits your right to cancel by any method permitted under applicable consumer protection law.

5. Schedule of Treatments

Under the Home Protection Plan, we will treat the premises on a bi-monthly schedule, plus or minus 15 days from the month indicated in the schedule section on the front of your agreement. Under the Mosquito Reduction Plan, we will treat the premises on the schedule shown on the first page of your agreement, plus or minus 15 days from the month indicated there. We reserve the right to change the treatment schedule if it becomes necessary, and we will advise you if this occurs.

After the initial service, you will receive correspondence notifying you of your upcoming service. You agree that posting notification at the property in advance of service is not required.

If you are not home for a scheduled service or for the initial service, we will treat all accessible areas of the premises and you will be charged the full net charge for that scheduled month. If part or all of the property or home is inaccessible, we will consider that month’s service complete and will return to treat the inaccessible areas at no additional charge, upon request. You are responsible for contacting us to schedule all follow-up visits, including follow-ups to free re-services.

Services may not be forgone, skipped or delayed within the Initial Service Commitment, except as provided under the Home Protection Plan warranty.

6. Circumstances Beyond Our Control

Our liability under your service agreement will be terminated if we are prevented from fulfilling our responsibilities under it by reason of transportation shortages of fuel or materials, strikes, embargoes, fire, floods, quarantine restrictions, natural disasters, or any other act of God or circumstance or cause beyond our control.

7. Occupants and Pest Control Devices

You agree to notify us, before any treatment, of any occupants who are allergic or sensitive to the products we use. You also agree not to tamper with, modify or move pest control devices that we use for pest control protection.

8. Price Changes

The price of the service may need to increase over time because of increased costs of maintaining the high quality of service our customers expect. There will be no increase in price during your Initial Service Commitment term.

If we increase the price of service after your Initial Service Commitment term, we will send you, at least 30 days before the change takes effect, a written notice setting out the new price and the date the increase takes effect. You may refuse the price increase and cancel your service agreement without cost, penalty or cancellation indemnity by sending us a notice to that effect no later than 30 days after the price increase takes effect.

Plan Commitment, Billing and Payment

Initial Service Commitment. Your service agreement has an Initial Service Commitment of 12, 18 or 24 months, as selected on the front of your agreement. Under the Home Protection Plan, if you do not select one, your Initial Service Commitment is 12 months. After the Initial Service Commitment, your agreement continues on the same seasonal schedule until you ask us to discontinue it as described in Item 4.

Minimum treatments. Under the Home Protection Plan, following the initial treatment, we will perform a minimum of five additional seasonal treatments if you select a 12-month commitment, eight additional treatments if you select an 18-month commitment, and eleven additional seasonal treatments if you select a 24-month commitment. Under the Mosquito Reduction Plan, following the initial treatment, we will perform a minimum of eight additional seasonal treatments if you select a 12-month commitment and seventeen additional seasonal treatments if you select a 24-month commitment.

Billing and payment. You choose either per-service billing, in which you are billed in each scheduled service month (called bi-monthly billing under the Home Protection Plan), or monthly billing, in which you are billed once per month. If you choose neither under the Home Protection Plan, billing defaults to bi-monthly billing. Prices shown on your agreement are plus applicable taxes. You authorize us to provide the treatments, including the application of pesticides, at the location shown on your agreement according to the treatment schedule, and to charge the payment card you provide after the initial service and on the billing schedule shown on your agreement.

Warranty

All pests covered by the Home Protection Plan carry our 100% warranty. If you are not completely satisfied with the results, we will re-service the affected areas at no charge. If the same activity is verified to persist after two complimentary re-services between regularly scheduled service visits, we will refund the last charge and end the service agreement with no cancellation fee.

This warranty applies to the pests covered by your Home Protection Plan and does not change the exclusions in Item 3. Carpenter ant coverage carries the separate warranty in Item 1(b). The Mosquito Reduction Plan is a reduction service and does not promise complete elimination of mosquitoes (see Item 1(b)).
